General terms and conditions of business of Museum Barberini gGmbH
The following general terms and conditions of business and payment shall apply to all admission tickets, event tickets, museum tours and annual tickets of Museum Barberini gGmbH purchased in the online shop or via the visitor service of Museum Barberini gGmbH.
1. Contract conclusion/ Event data
When purchasing admission tickets, event tickets, museum tours and annual tickets, the contractual relationship shall materialise solely between Museum Barberini gGmbH and the customer. Said customer shall commission Museum Barberini gGmbH to handle the contracts. Products will only be sold to end customers and authorised resellers.
By confirming the order on the Museum Barberini gGmbH website or by telephonic or written order vis-à-vis the visitor service, the customer makes an offer to conclude a contract with Museum Barberini gGmbH. By e-mail confirmation, Museum Barberini gGmbH accepts the offer. The reservation is thus binding, with cancellation only being possible subject to the following terms and conditions.
2. Prices and payment
The prices offered for admission tickets, event tickets, museum tours and annual tickets are exempted from value added tax pursuant to Section 4 no. 20 a German Turnover Tax Act (Umsatzsteuergesetz; UStG). Payment shall be made in advance by the customer via Visa and MasterCard credit card, via Paypal or by means of the electronic direct debiting system. Payment at the ticket desk is also possible during the museum tour for services reserved via the visitor service. Please note that the Museum Barberini does not accept any EUR 200 and EUR 500 notes for security reasons. Upon consultation, a retroactive payment on account may also ensue in return for a fee in exceptional cases. Payment by voucher or collective invoice is only possible in the event of a corresponding agreement.
The dispatch of confirmations, invoices, print-at-home tickets for admission tickets, event tickets and museum tours ensues at the customer’s own risk to the specified e-mail address. The risk of accidental loss shall transfer to the customer upon transfer to the dispatch company. No replacement shall be made. Until such time as full payment has been made, the product shall remain the property of Museum Barberini gGmbH.
4. Admission tickets, event tickets and museum tours
The reduced or free museum tours, admission tickets and event tickets are only valid in conjunction with the corresponding verifications. The latter must be presented at the ticket desk or at the entrance when visiting the museum.
A restriction on participation per reserved appointment applies to all group tours. Group tours shall be implemented by a guide commissioned by Museum Barberini gGmbH following a positive reservation confirmation. The selection of the guide shall be incumbent upon Museum Barberini gGmbH. The specified registration deadlines and tour modalities apply.
Tours offered by third parties rather than Museum Barberini gGmbH are only admissible subject to prior approval and in return for a separate remuneration of EUR 40 per tour (so-called licensed tour). 5. Annual tickets
The annual tickets are valid for all Museum Barberini gGmbH events during all opening hours and with no additional payment.
The annual ticket includes a preferred admission, with no separate admission ticket needing to be collected from the ticket desks.
The following three annual tickets are available:
Barberini Friend: EUR 30 / annual ticket for an adult
Barberini Friends: EUR 50 / annual ticket for couples
Barberini Young Friend: EUR 20 EUR / annual ticket for an adult of 35 years old and below.
The annual tickets are personal and not assignable. Photo ID must be shown at the entrance.
The annual tickets are valid 12 months from the date of issue.
Should the annual ticket be lost or misplaced, a replacement ticket may be issued in return for a processing fee of EUR 5. In such case, the lost or misplaced annual ticket ceases to be valid.
The annual tickets shall be purchased and issued at the ticket desk of Museum Barberini gGmbH. Gift certificates for the various annual tickets may also be purchased at the ticket desk. No partial redemption of gift certificates is admissible.
The 14-day legal right of revocation applies to gift certificates purchased online or by telephone. Gift certificates purchased at the museum ticket desks shall be exempt from the right of revocation or return in exchange for cost reimbursement; no replacement may be made for lost gift certificates purchased at the ticket desks. All gift certificates are valid for three years, with this period beginning upon expiry of the year in which the purchase was made.
Paid admission tickets and event tickets will not be reimbursed or exchanged. The following shall apply to group tours and the associated tickets:
A cancellation of group tours is possible either by letter to Museumsführungen, Eintrittskarten und Veranstaltungstickets, Besucherservice, Friedrich-Ebert-Str. 115, 14467 Potsdam, by fax +49 331 979920 183 or by e-mail to email@example.com. No cost contribution will be levied in the event of cancellations made up to 10 days before the appointment. In such case, the full invoice amount of the cancelled performance will be reimbursed. The full invoice amount will fall due for payment for cancellations made after the previously mentioned deadline or for non-appearance of the group at the agreed appointment. The decisive criterion for adherence to the deadline is the receipt of the cancellation by Museum Barberini gGmbH, with the customer being required to furnish the proof to this end. No cancellation of individual performances of the offer is possible; the full amount of the agreed remuneration will fall due for payment in the event of a reduction in the number of participants. No liability shall be assumed for any cancellation of the event due to force majeure or such like. A postponement of up to 30 minutes of the event start cited in the offer shall not entitle the ticketholder to a reduction in the remuneration.
Individual areas of the Museum Barberini may be closed for constructional or organisation reasons. In such cases, all compensation claims will be excluded.
Museum Barberini gGmbH shall only assume liability in the event of intent and gross negligence. This shall not apply in cases of injury to life, limb or health or to infringement of essential contractual duties (those whose fulfilment is an absolute prerequisite for achieving the contractual purpose); Museum Barberini gGmbH shall be liable according to the statutory provisions in such cases. On no account shall it assume liability for intangible damage or for lost profit. As far as the amount is concerned, Museum Barberini gGmbH shall only assume restricted liability for any typically foreseeable damage, which does not usually exceed the price of the museum tour, admission ticket or the event ticket and does not include the frustrated costs of arrival and accommodation.
8. Data protection
In order to process the contractual relationship, the customer’s name and address as well as e-mail address and telephone number will be saved and utilised for the duration of the contractual relationship. Those employees of Museum Barberini gGmbH entrusted with the processing of the contractual relationship shall have access to such data as shall those commissioned service providers specifically committed to careful handling of such data solely for the purposes of contract processing. The customers shall immediately inform Museum Barberini gGmbH of any changes in such data.
With the customer’s explicit consent, name, address, telephone number and e-mail address may also be transferred to the general address file of Museum Barberini gGmbH, which serves the visitor service. 9. Final provisions
Museum Barberini gGmbH shall reserve the right to amend these terms and conditions without providing any reason at any time. Such amendments shall not apply to reservations already made. Should individual provisions be or become invalid, this shall not affect the validity of the remaining contract. The law of the Federal Republic of Germany applies exclusively. The application of the UN Convention on the International Sale of Goods shall be excluded. Sole place of fulfilment for delivery, performance and payment is Potsdam. The place of jurisdiction for all disputes arising with merchants, legal entities under public law and special funds under public law, as well as persons having their place of residence or habitual abode abroad is Potsdam.
